A trade mark is an intellectual property of a business which helps in distinguishing its products as well as services from similar goods or services of other companies. Trademark can be in the form of words, images, slogan, sound, graphics, colours, or a combination of all. After filing the application you can use TM symbol next to the registered trade mark and the ® symbol can be use once the trademark is registered.
KPM Associate assists in registering a trade mark in India in simple steps
Step 1 : Trademark search in the Trademark registry helps to ensure no identical or similar brands have been registered anywhere in the business arena. An exclusive trademark search helps in avoiding legal problems associated with using others registered brand by mistake, other than saving cost associated with advertising, printing and marketing.
Step 2 : File an application with Intellectual property office online. You must include details of product/services for which you wish to register and its appropriate trade mark class.
Step 3 : You will get a TM symbol in two days, but have to wait for few months to get ® symbol. You will receive an examination report from the Trademark registry within 8 months. This report tells you whether to make changes in the submitted logo. You must reply to the examination report within one month. If registry is satisfied with your trademark logo, then your application will be published in the trade marks journal publication for three months to allow third-parties to oppose the registration.
Step 4 : After published in the Trademark journal, your trade mark will be registered and you will receive trademark certificate for each brand. If any opposition is raised, you will be given the option to withdraw your application, discuss the conflict with the concerned party, or defend the application. Brand name registration is valid for 10 years and can renew after that. Moreover, you have to file form 16 with trademark registry for making changes in your name, address or contact details.
